Supreme Court Decision: Does Not Have an Organizational Connection, Not Aware of the Coup Attempt!

My dear friends,

In my previous article, I shared with you the martyrdom of our brother in arms, our commander, martyr Brigadier General Mehmet Şükrü EKEN as a result of the solitary confinement that he was kept under the conditions of “aggravated life imprisonment.” He had been kept under these conditions—conditions that are considered torture—since he was in a so-called “dangerous criminal” category.

Now, I will share with you the unlawfulness and weirdness experienced in his court proceedings. I will not bore you with the complexity of the legal process and the complicated notions of the law articles. I will explain the issue in terms of decisions made at different court levels.

  1. In the domestic court: In it's decision dated April 16, 2018, which was taken after 1.5 years after July 15, Samsun 3rd High Criminal Court based its verdict on evidence (reports of MIT and General Staff, official reports) without presenting its contents and on a number of “guesses”, “interpretations” and “readings of intent” that had no material grounds.

        a. Although the witnesses refused, the court used the statement “The Martial Law Directive has been initiated by giving an order as the Commander of Martial Law” in its verdict. Actually, only barracks security measures were increased, and vehicles, personnel and weapons were prohibited to leave the barracks.

        b. The two Zaman newspapers from 2014, which were found in the search carried out in the warehouse where his household goods were located at Turkish Military Academy, were used as evidence that he was a member of the terrorist organization.

        c. The punishment of the so-called crime was determined as "aggravated life imprisonment" at the highest level. However, considering the good conduct of our Commander in the court, his sentence was reduced to "life imprisonment" as a manifestation of the court's so-called justice and mercy. (However, as a dangerous criminal (!), he was kept in solitary confinement until his death).

    2. The Court of Appeal, on the other hand, accepted the verdict of the domestic court exactly.

    3. In the Supreme Court: 

        a. He has no organizational link,

        b. It has not been proven that he was aware of the coup attempt and that he participated in the decision and will to commit a crime.

        c. His concrete actions could either not be determined. However, after the commencement of the execution of the crime, it has been determined that his actions that clearly showed his will to participate were aimed at facilitating the execution of the coup as a whole in terms of their contribution to the time, quality and danger of immediate harm. In this context, it was decided that his actions constitute the crime of assisting the crime of attempting the violation of the Constitution and that the punishment should be determined by taking into account the position of the defendant and the duty undertaken, and that a provision should be established accordingly.

 

Crypto Pro-Iran Regime Group's Effect in Turkey 

My dear friends,

Although the Supreme Court made this decision on October 14, 2019, the domestic court has not looked at the case again for 1.5 years. By keeping our commander under the conditions of "Aggravated Life Imprisonment", which is accepted as "torture" by international courts, the court caused him to die suspiciously from Covid-19.

However, the sentences given for aiding the coup vary between 12-18 years. Considering the duration he would spend in prison, our commander could have come out after 5-6 years; but he was martyred by the AKP’s “bloody justice” with its “Iran Mullah Regime's grudge.” Why did I say “Iran Mullah Regime's grudge?” First of all, everyone should know that Turkish Armed Forces has no problem with or hostility toward any belief, ethnic origin, sect or group within the scope of fundamental rights, freedom of thought and belief, and it should not. However, one of the main veins of the AKP and one of the "mentors" of July 15 is the crypto pro-Iran group (in Turkey) that is a sympathizer of the Iran Mullah Regime and it makes itself look like different people to the people of this country. Iran Mullah Regime asked the opponents they imprisoned after the 1979 Iranian revolution to repent—in the light of what is happening today, it means to be a confessor—so that “we can release and forgive you.” However, according to the official figures, around 3500 opponents were killed in prisons in 1983. This was around 6500 according to the unofficial figures.

If you remember, these evil focuses were planning to martyr our friends with the suspicion that "they will revolt in prisons" in 2018 and before. Fortunately, they did not dare to do so. One can’t stop thinking: how can the COVID-19 virus be transmitted to our Commander who had been kept in solitary confinement for 1644 days? Or are they realizing these plans today through Covid-19? May God not give you the opportunity.

Hoping that justice will be manifested as soon as possible, we once again wish God's mercy on our Commander.
