A Professional Manipulation Example: The Military Academy (TMA) Indictment

WhatsApp Group Detail in the Grounds of the Case

The matters manipulated by the prosecutor's office in the indictment of Turkish Military Academy and the court's acceptance of these mind-blowing allegations during the trials make you say "Where is the Justice?" We share with you the facts regarding the following allegation, which is the reason why many innocent defendants are sentenced to life imprisonment.

During the trial, the prosecutor's office stated that “… The martial law directive, which reached KONMER at 23:04, was sent to the dean's office, and the military personnel working in the units actively involved in the insurrection via the WhatsApp messages sent to the WhatsApp group by Devrim Çamur at around 23:07." With this statement the prosecutor's office claimed that the dean’s staff actively participated in the coup. We have tried to explain the elements of this claim below.

• The WhatsApp group in the file was created exclusively for the personnel involved in the (so-called) coup attempt,
• Devrim Çamur, the Director of the Dean's Administrative Branch, conveyed the martial law directive to the personnel through the WhatsApp message at 23:07,
• The personnel who were called to work by Devrim Çamur were actively assigned during the attempt and therefore were specially selected.

Let's examine the issues in these 3 claims one by one and see if they are true or not.

• First of all, the perception that a special WhatsApp group was created on the night of July 15 was tried to be created by the prosecutor, but the reality is very different from what was stated. The WhatsApp group in question was created after the Merasim Sokak terrorist attack on 17 February 2016, within the framework of the order given by the Commander of the TMA, Major General İzzet Çetingöz, and has been actively used ever since.

• Secondly, the information that the martial law directive was conveyed by Devrim Çamur to the dean's staff via WhatsApp message is completely false. Because the martial law directive reached the Turkish Military Academy KONMER system at 23:04, however, the arrival time of the message was determined as 23.02 in the information obtained from the phones of 10 of those who received the message. It is not possible to send this at a time when the martial law directive does not come. It is a clear example of manipulation that the prosecutor's office and the court took into account the phone time of Devrim Çamur, which was 5 minutes ahead. Moreover, the content of the message is visible in the WhatsApp screenshot of the recipients, there is no illegal order or reference to the martial law directive in this image.

• Thirdly, the arrival of personnel to overtime is in accordance with the ordinary flow of life due to the experience of being called to work several times in the morning or at midnight by the order of Commander of the TMA, Major General İzzet Çetingöz. In addition, military legislation obliges all units to have troops ready in case of revolution or rebellion. Therefore, being called to overtime was not found strange by the relevant personnel. The claim that the personnel were specially selected and that they were actively involved in the so-called attempt is unrealistic. Because the message was sent to the entire dean's WhatsApp group, and this group was created by the order of the TMA commander about 6 months ago. In addition, most of the personnel summoned did not have any activity other than ensuring the security of the barracks.

This claim was not only brought to the agenda by the prosecutor, but also found its place in the reasoned decision by the court, which was expected to dispense justice. The defendants' proof of this was disregarded and another dagger was stabbed in the bosom of justice. We would like to remind you that the owner of the indictment, Prosecutor Adem Akıncı, is also the prosecutor of the Karlov Assassination, whose smoke curtain has not yet been opened, and that he is remembered as one of the militant prosecutors of the regime!
